Prior to receiving any prize, each selected potential winner will be required to complete and return an Affidavit of Eligibility, Liability Release, and (where legally permissible) Publicity Release within five (5) business days of receiving notification. The Affidavit may be completed and returned via electronic signature. Grand Prize potential winners must additionally provide, as part of the Affidavit submission: (a) a photo of valid, government-issued identification confirming identity and age (18 years of age or older); and (b) a photograph of the potential winner holding that identification (a “selfie”), optionally alongside a sheet of paper displaying the current date, to assist with verification. Sollia uses these materials solely to confirm the Grand Prize potential winner’s age and eligibility. Founding Member and Runner-Up potential winners are not required to submit government-issued identification or a selfie unless Sollia reasonably determines, in its discretion, that additional documentation is necessary to resolve a specific eligibility concern (for example, a suspected duplicate or fraudulent entry, or a question regarding residency within the Eligible Area). Regardless of prize tier, Sollia reserves the right, in its sole discretion, to request additional documentation from any potential winner at any time - including government-issued identification, proof of residency within the Eligible Area, or other reasonable documentation - to verify eligibility, including in response to suspected fraud, duplicate entries, or other suspicious activity. Failure to provide requested documentation within the time specified by Sollia may result in disqualification and the selection of an alternate winner. Failure to return a properly completed Affidavit within this period may result in disqualification and the selection of an alternate winner. Grand Prize potential winners must additionally provide confirmation of their ability to participate in the Philadelphia, PA date-night experience or acknowledge the substitution process described in Section 5.7. Affidavits and identity verification documents will be submitted through a secure Google Form provided to the potential winner, as further described in Sollia’s Privacy Policy. Identity verification documents are retained only as long as necessary to complete winner verification and prize fulfillment and are then securely deleted. The Affidavit will require each potential winner to certify, at minimum, that: (i) all information the entrant has provided is true and accurate; (ii) the entrant understands they may be required to provide identification or additional documentation to verify eligibility; (iii) the entrant understands that one or more prizes or prize components may be provided by third-party Prize Providers and that the entrant is solely responsible for any costs exceeding the stated prize value; (iv) where applicable, the entrant understands the Grand Prize may consist of multiple components; (v) where applicable, the entrant understands that Founding Member benefits are subject to the App’s platform terms and may evolve over time, as further described in Section 5.7; and (vi) the entrant resides within the Eligible Area described in Section 3.2 and understands that Giveaway prize eligibility is limited to residents of that area. By accepting a prize, each winner: (a) releases and holds harmless Sollia and, where applicable, any Prize Provider that provided or contributed to that winner’s prize, together with each of their respective officers, directors, members, employees, agents, and contractors, from any and all liability arising from participation in the Giveaway or the receipt, use, non-performance, or quality of any prize; (b) grants Sollia a non-exclusive, royalty-free, worldwide license to use the winner’s first name, last initial, state of residence, and (with the winner’s explicit written consent in the Affidavit) full name, Instagram handle, and likeness for promotional and marketing purposes in any media now known or hereafter developed, without additional compensation or prior notice unless prohibited by applicable law; and (c) acknowledges that all applicable federal, state, and local taxes on prizes are the winner’s sole responsibility. Winners who do not consent to publicity use of their full name or likeness must indicate this in the Affidavit; such objection does not affect the winner’s eligibility to receive their prize.
